  1. Acceptance of Terms

By accessing or using The Sweet Swirl’s website, placing an order through ToastTab, or making a purchase in-store, you agree to comply with these Terms & Conditions. If you do not agree with any part of these terms, please refrain from using our services.

  1. Ordering & Payment

2.1 Online Orders

  • All orders placed online through ToastTab must be paid in full at the time of checkout.
  • We accept major credit cards, debit cards, and digital payment methods as available through ToastTab.
  • Customers are responsible for ensuring that their order details (such as flavors, quantities, and pickup times) are accurate before confirming the order.

2.2 In-Store Purchases

  • All in-store purchases must be paid in full at the time of sale.
  • We accept cash, credit/debit cards, and digital payments where available.

2.3 Third-Party Payment Processing

  • Payments processed through ToastTab or other third-party services are subject to their respective terms and conditions.
  • The Sweet Swirl is not responsible for any issues arising from third-party payment processors, including declined transactions, security breaches, or payment errors.

  1. Refunds & Cancellations

3.1 Order Cancellations

  • Orders may be canceled only before the preparation process begins.
  • Once preparation has started, the order cannot be canceled, and no refund will be issued.

3.2 Refund Policy

  • Refunds may be granted at our discretion under the following circumstances:
    • Errors in order fulfillment (e.g., incorrect items provided).
    • Quality issues, such as a defective or spoiled product.
    • Unforeseen service disruptions, such as store closures due to emergencies.
  • Refunds will not be granted for:
    • Customer preference changes after the order has been prepared.
    • Orders not picked up within the designated pickup window.
    • Melted or altered products due to delayed pickup or improper storage.

3.3 Issue Resolution Policy

  • If a customer experiences a problem with their order (e.g., incorrect item, quality issue), they must notify us immediately upon receipt.
  • Complaints should be reported in person or via phone/email within 4 hours of purchase.
  • Resolutions will be determined on a case-by-case basis and may include a replacement (if reported immediately), store credit, or a refund at management’s discretion.

  1. Website & Online Services

4.1 Proper Use

  • Customers may not use The Sweet Swirl’s website for unlawful, fraudulent, or unauthorized activities.
  • Any attempts to disrupt or manipulate our website or ordering system will result in termination of access and possible legal action.

4.2 Account Responsibility

  • If you create an account on our website or ToastTab, you are responsible for maintaining the security of your login credentials.
  • Any unauthorized access to your account must be reported immediately. The Sweet Swirl is not responsible for losses resulting from compromised accounts.

  1. Product Availability & Pricing

5.1 Menu Changes

  • We reserve the right to update our menu, adjust prices, or discontinue items without prior notice.
  • Certain flavors and seasonal items may only be available for a limited time.

5.2 Pricing & Errors

  • Prices listed on our website and ToastTab are accurate at the time of display, but we reserve the right to correct pricing errors.
  • In the event of a pricing mistake, we may cancel an order and issue a full refund if the correct price is not acceptable to the customer.

  1. Limitation of Liability

The Sweet Swirl is not responsible for:

  • Errors, delays, or disruptions caused by third-party services like ToastTab.
  • Losses due to unauthorized access to customer accounts.
  • Personal injuries, allergic reactions, or adverse effects resulting from the consumption of our products. Customers are responsible for reviewing ingredient information and notifying staff of any allergies before placing an order.
  • Any damages arising from misuse or improper storage of our products after purchase.

  1. Health & Safety Policy

  • All of our products are prepared in a facility that may handle common allergens, including dairy, nuts, soy, and gluten.
  • Customers with severe allergies should contact us directly before ordering to discuss possible accommodations.
  • For food safety reasons, once a product has been picked up or delivered, it is the customer’s responsibility to store and consume it properly.

  • We reserve the right to update or modify these Terms & Conditions at any time.
  • Any changes will be posted on our website, and continued use of our services constitutes acceptance of the updated terms.
